Virtual Tour Hosting Policy

This Virtual Tour Hosting Policy governs the hosting, access, availability, storage, maintenance, and use of virtual tours, digital twins, Matterport tours, off-plan tours, and related hosted content provided by FOCUSSTUDIO360 FOR COMMERCIAL PHOTOGRAPHS PRODUCTION (“Focus Studio 360”, “we”, “our”, or “us”).
By purchasing, accessing, using, embedding, or sharing any hosted virtual tour, you agree to this Policy.

1. Third-Party Hosting Providers
Focus Studio 360 utilizes third-party hosting platforms, cloud infrastructure providers, software platforms, and related technologies to deliver virtual tours and digital content.
Hosted services may rely upon:
- Matterport
- Cloud hosting providers
- Content delivery networks (CDNs)
- Internet infrastructure providers
- Third-party software platforms
- Other technology providers
Focus Studio 360 does not own or control all hosting infrastructure used to provide hosted content.
2. No Guarantee of Continuous Availability
While Focus Studio 360 aims to provide reliable hosting services, we do not guarantee:
- Continuous availability
- Uninterrupted access
- Error-free operation
- Permanent hosting
- Permanent storage
- Continuous uptime
Virtual tours may become unavailable due to factors beyond our control.
3. Secondary Property Hosting
Unless otherwise agreed in writing:
Included Hosting
Matterport tours and related hosted content for secondary properties include:
One (1) month of hosting from the date of scanning.
After the included hosting period expires, additional hosting may be available at the prevailing rates published by Focus Studio 360.
At the time of publication, additional hosting is generally charged at:
AED 50 per month per property
Pricing may be modified at any time without notice.
4. Expired Hosting
If a hosting renewal is not purchased before expiration:
Focus Studio 360 may:
- Suspend access
- Disable access
- Archive content
- Remove content
- Delete content
- Remove embedded links
- Remove public access
We are under no obligation to retain expired tours indefinitely.
Reactivation of Archived or Suspended Tours
Where a secondary property virtual tour has been archived, suspended, deactivated, or removed from active hosting due to non-payment, expiration of the included hosting period, or failure to renew hosting services, the client may request reactivation subject to availability.
Reactivation is not guaranteed and remains subject to the continued availability of the tour and the underlying hosting platform.
A reactivation fee of AED 50 per tour shall apply in addition to any applicable hosting fees or renewal charges.
Focus Studio 360 reserves the right to refuse reactivation where the tour has been permanently deleted, is no longer recoverable, or where continued hosting is no longer commercially or technically feasible.
5. Off-Plan Virtual Tours
Off-plan virtual tours may remain available for periods determined solely by Focus Studio 360.
Focus Studio 360 reserves the right to:
- Modify tours
- Replace tours
- Archive tours
- Suspend tours
- Remove tours
- Discontinue tours
at any time and for any reason.
No guarantee is made regarding the duration of availability of any off-plan tour.
6. Hosting Renewals
Clients are responsible for monitoring hosting expiration dates and arranging renewals where applicable.
Failure to renew hosting may result in:
- Suspension
- Removal
- Archiving
- Permanent deletion
No refunds shall be provided for expired hosting periods.
7. Data Loss Disclaimer
Although reasonable efforts may be made to preserve hosted content, Focus Studio 360 does not guarantee protection against:
- Data loss
- Corruption
- Deletion
- Platform failures
- Software failures
- Hosting provider failures
- Cybersecurity incidents
- Human error
- Force majeure events
Clients are encouraged to maintain independent copies of any content provided to them.
8. Third-Party Service Interruptions
Focus Studio 360 shall not be liable for interruptions caused by:
- Matterport outages
- Cloud provider outages
- Hosting provider outages
- DNS issues
- Internet disruptions
- Software failures
- API failures
- Cybersecurity incidents
- Maintenance windows
- Platform changes
Such events shall not entitle clients to:
- Refunds
- Credits
- Compensation
- Damages
9. Embedded Tours
Clients may embed virtual tours on their own websites where permitted.
Focus Studio 360 shall not be responsible for:
- Website compatibility issues
- Browser compatibility issues
- Website configuration errors
- Third-party website failures
- Broken embeds caused by client modifications
10. Unauthorized Access
Clients are responsible for maintaining the security of any login credentials, passwords, private links, or access information provided to them.
Focus Studio 360 shall not be responsible for losses resulting from:
- Credential sharing
- Unauthorized disclosure
- Account compromise
- Third-party access
11. Hosting Suspension
Focus Studio 360 reserves the right to suspend or terminate hosting services where:
- Payment obligations are not met
- Licensing terms are violated
- Copyright infringement occurs
- Illegal activities are detected
- Abuse of services occurs
- Hosting providers require removal
- Legal requirements require removal
12. No Business Guarantee
Focus Studio 360 makes no representation that hosted virtual tours will:
- Generate leads
- Generate sales
- Increase property inquiries
- Increase conversions
- Produce marketing results
Any business outcomes depend upon factors outside the control of Focus Studio 360.
13. Limitation of Liability
To the fullest extent permitted by law, Focus Studio 360 shall not be liable for:
- Lost sales
- Lost commissions
- Lost profits
- Lost opportunities
- Business interruption
- Data loss
- Hosting downtime
- Service interruptions
- Third-party failures
In all circumstances, the maximum liability of Focus Studio 360 shall not exceed the amount paid by the client for the specific hosted service giving rise to the claim.
14. Force Majeure
Focus Studio 360 shall not be liable for any delay, interruption, outage, suspension, failure, or loss arising from events beyond its reasonable control, including:
- Internet outages
- Hosting outages
- Cloud provider failures
- Natural disasters
- Government actions
- Utility failures
- Cybersecurity incidents
- Telecommunications failures
- Labour disruptions
15. Governing Law
This Policy shall be governed by the laws of the United Arab Emirates.
16. Jurisdiction
Any dispute relating to hosted content or hosting services shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.
